EcolabellingDenmark always conducts a site visit (inspection visit) before a company isgran- ted a licence, no matter where in the world the products are made. Thepurpose of this visit is partly to assess whether the product, productionconditions and work procedures match what has been described in thedocumentation submitted by the company. Additionally, the visit also allowsEcolabelling Denmark to inspect and ensure that the company has a qualityassurance system in place - i.e. a system which helps ensure that, in thecourse of its daily activities, the company complies with the requirements setout in the relevant criteria.

Aspart of the ongoing annual follow-ups, random checks are made among thecompanies holding a licence – so-called follow-up inspections. The scope ofthis work ensures that all companies are inspected at least once within theperiod for which their licence is valid.

EcolabellingDenmark also systematically surveys the use of the ecolabels on websites, inadvertising material and in marketing in general. This is called marketsurveillance, and covers licence-holders and distributors and random samplingin advertisements and other marketing materials etc. In a single year, the focuscan be on a specific sector - or on former licence-hol- ders (to check thatthese companies do not continue using the ecolabels).

Thisusually takes the form of a scheduled inspection, where an Ecolabelling Denmarkemplo- yee looks at whether the company and its products/services comply withthe requirements of the criteria. As mentioned above, this can happen in anumber of different ways.

Themost common infringements of the rules include:

• themanufacturer has replaced raw materials and/or subsuppliers without/beforehaving the change approved by Ecolabelling Denmark. In many cases, the productstill lives up to the ecolabelling criteria, but there are also examples ofproducts which do NOT live up to the criteria. Such infringements can bediscovered through on-site visits, checking the production specifications or bytesting the product.

Themost common infringements include:

• useof the ecolabel even though the company does not hold a licence.

Dependingon the nature of the infringement, sanctions range from a demand that theproblem be rectified, to submission of a written and signed statement orwithdrawal of the licence. Ecolabelling Denmark may report the company to thepolice in the event of particularly severe infringements. In addition,companies that use the Nordic Swan Ecolabel after the licence has expired afinancial compensation based on the fee the company should have paid may beimposed. Companies which are reported to the police may also be required to paya fine by the prosecutor.
